Welcome to NAFROK. By accessing our website and using our web design and development services, you agree to be bound by these Terms of Service. Please read these terms carefully before engaging our services.
1. Acceptance of Terms
By using NAFROK's services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, please do not use our services.
These terms constitute a legally binding agreement between you (the "Client") and NAFROK (the "Agency").
2. Service Delivery Guarantee
Our Commitment: We guarantee project delivery within 1-3 weeks from the project start date, based on working days (Monday through Friday, excluding public holidays).
Delivery Timeline Details
- Working Days: The 1-3 week timeline is calculated based on business working days only (Monday to Friday)
- Exclusions: Weekends, public holidays, and government-declared holidays are not counted in the delivery timeline
- Project Start Date: The timeline begins after the initial payment is received and all project requirements are finalized and approved by the client
- Scope-Dependent: Simple projects may be delivered in 1 week, while more complex projects may take up to 3 weeks
- Clear Communication: You will receive a specific delivery date in your project proposal based on your requirements
Important Note
Delivery timelines may be extended if the client fails to provide required content, feedback, or approvals within the agreed timeframe. Additional features requested after project commencement may also extend the timeline.
3. Money-Back Guarantee
Our Promise: We stand behind our work with a comprehensive money-back guarantee to ensure your complete satisfaction.
Refund Policy Structure
Full Refund (100%): You are eligible for a complete refund if:
- We fail to deliver the project within the agreed 1-3 week timeline (calculated in working days)
- We fail to start the project within 3 working days of receiving payment and finalized requirements
- The project has not progressed beyond the initial consultation phase
- No design concepts or development work has been delivered
Partial Refund (40%): You are eligible for a 40% refund if:
- All initial project requirements have been met as per the approved project scope
- At least two rounds of revisions have been completed by NAFROK
- The client is still not satisfied with the final deliverable despite meeting all agreed specifications
- The request is made within 14 days of the final delivery
Refund Exclusions
Refunds will not be provided in the following circumstances:
- Client Delays: If project delays are caused by the client's failure to provide timely feedback, content, or approvals
- Scope Changes: If the client requests significant changes to the original project scope after work has commenced
- Third-Party Services: Costs for third-party services (domains, hosting, premium plugins, stock images) are non-refundable
- Completed Projects: After the final deliverable has been approved and accepted by the client
- Post-Launch Period: More than 14 days after final project delivery
- Change of Mind: Simple change of mind without valid quality concerns
Refund Process
- Refund requests must be submitted in writing via email to contact.nafrok@gmail.com
- Include your project details, invoice number, and specific reasons for the refund request
- NAFROK will review your request within 3-5 business days
- Approved refunds will be processed within 10-14 business days
- Refunds will be issued to the original payment method
Refund Approval Authority
All refund requests are subject to NAFROK's sole discretion and approval. The final decision to approve or deny any refund request rests exclusively with NAFROK management. By using our services and agreeing to these Terms of Service, you acknowledge and accept that NAFROK has the absolute authority to evaluate refund eligibility based on the criteria outlined above. While we strive to be fair and transparent, we reserve the right to make the final determination on all refund matters.
4. Services Offered
NAFROK provides the following web design and development services:
- Custom website design and development
- Responsive web design for all devices
- E-commerce website development
- Google Search Engine Optimization
- Website redesign and optimization
- Landing page design and development
- Website maintenance and support
- UI/UX design services
Specific deliverables and project scope will be outlined in the individual project proposal or contract.
5. Client Responsibilities
To ensure timely project delivery and the best possible outcome, clients agree to:
- Provide Content: Supply all necessary content, images, logos, and materials within agreed timelines
- Timely Feedback: Respond to requests for feedback and approvals within 3 business days
- Clear Requirements: Provide clear, detailed project requirements at the project start
- Single Point of Contact: Designate one primary contact person for all communications
- Payment Terms: Make payments according to the agreed schedule
- Scope Adherence: Understand that additional features beyond the agreed scope may incur extra charges and extend timelines
- Testing: Review and test delivered work promptly and report any issues within the revision period
Important: Delays in client responses or content provision will extend the project timeline accordingly and may affect guarantee eligibility.
6. Revisions and Changes
Included Revisions
- Two rounds of revisions are included in all standard projects
- Revisions must be based on the original agreed project scope
- Each revision round must be completed before the next begins
- All revision requests must be submitted in writing
Additional Revisions
- Revisions beyond the included rounds will be charged at our standard hourly rate
- Major scope changes require a separate quote and timeline adjustment
- We will notify you before any additional charges are incurred
Scope Changes
Changes to the original project scope (new features, pages, or functionality) require:
- Written approval of the change request
- Additional payment based on the complexity of changes
- Adjusted timeline for delivery
7. Payment Terms
Payment Structure
- Deposit: 50% upfront payment required to commence work
- Final Payment: 50% due upon project completion before final delivery
- Payment Methods: We accept bank transfer, UPI, credit/debit cards, and other digital payment methods
- Currency: All payments are in Indian Rupees (INR) unless otherwise agreed
Late Payments
- Final deliverables will not be released until full payment is received
- Projects may be paused if payment milestones are not met
- Late payment fees of 2% per week may apply after 7 days
Third-Party Costs
The following are not included in our service fees and are billed separately:
- Domain registration and renewal fees
- Web hosting services
- Premium plugins or themes
- Stock photography or licensed content
- SSL certificates (if not included in hosting)
- Third-party API integrations
8. Intellectual Property Rights
Client Ownership
Upon full payment, you will own:
- The final website design and content specific to your project
- Custom graphics and visual elements created for your project
- Text content written specifically for your website
Agency Retention
NAFROK retains rights to:
- Reusable code frameworks and development methodologies
- Pre-existing tools, templates, and libraries
- Display the project in our portfolio
- Use the project as a case study (with client permission)
Third-Party Rights
Clients must ensure they have proper rights to all provided materials including:
- Logos, branding materials, and trademarks
- Images, videos, and multimedia content
- Text content and copy
- Any third-party software or plugins requested
9. Confidentiality
Both parties agree to maintain confidentiality regarding:
- Proprietary business information shared during the project
- Trade secrets and confidential data
- Client information and business strategies
- Login credentials and access information
This confidentiality obligation continues for 2 years after project completion, except for information that becomes publicly available or is required by law to be disclosed.
10. Warranties and Disclaimers
Our Warranty
NAFROK warrants that:
- Services will be performed with professional skill and care
- Work will be substantially free from defects for 30 days post-launch
- Website will function as intended on modern browsers and devices
- We have the right to provide the services offered
Limitations
We do not warrant:
- Specific results, traffic levels, or search engine rankings
- Compatibility with all future browser or device updates
- Uninterrupted or error-free operation
- That the website will meet all your business objectives
Testing Period
- Clients have 30 days post-launch to report bugs or functionality issues
- Bug fixes within this period are provided at no additional cost
- Issues must be clearly documented and reproducible
- After 30 days, support is available at our standard rates
11. Limitation of Liability
To the maximum extent permitted by law:
- NAFROK's total liability is limited to the amount paid for the specific project
- We are not liable for indirect, incidental, or consequential damages
- We are not responsible for loss of profits, data, or business opportunities
- We are not liable for third-party actions or services
- Client assumes responsibility for regular backups of their website
Note: Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
12. Support and Maintenance
Post-Launch Support
- 30 days of free bug fixes and technical support post-launch
- Support covers issues related to original project scope only
- Response time: within 2 business days for support requests
Ongoing Maintenance (Optional)
We offer optional maintenance packages including:
- Regular software and plugin updates
- Security monitoring and patches
- Content updates and minor changes
- Monthly backups and performance checks
- Priority support response times
Maintenance packages are available at additional cost and require a separate agreement.
13. Project Cancellation
Client Cancellation
- Clients may cancel projects with written notice
- The deposit (50%) is non-refundable if work has commenced
- Additional charges apply for work completed beyond the deposit
- All work completed up to cancellation remains property of NAFROK until full payment
Agency Cancellation
NAFROK reserves the right to cancel a project if:
- Client fails to make payment as agreed
- Client fails to provide required materials after 30 days
- Client breaches these terms of service
- Project scope is fundamentally different from what was agreed
In case of agency cancellation due to client breach, all payments made are non-refundable.
14. Dispute Resolution
Informal Resolution
Both parties agree to first attempt informal resolution of any disputes through good-faith negotiations.
Mediation
If informal resolution fails, disputes will be submitted to mediation before pursuing legal action.
Jurisdiction
- These terms are governed by the laws of India
- Courts in Bangalore, Karnataka have exclusive jurisdiction
- Any legal proceedings must be conducted in English
15. General Provisions
Entire Agreement
These Terms of Service, together with any project proposal or contract, constitute the entire agreement between parties.
Modifications
We may update these terms at any time. Material changes will be notified to active clients. Continued use of our services after changes constitutes acceptance.
Severability
If any provision is found unenforceable, the remaining provisions continue in full force and effect.
Force Majeure
Neither party is liable for delays caused by circumstances beyond reasonable control including natural disasters, pandemics, government actions, or internet service disruptions.
Assignment
Clients may not assign their rights under these terms without written consent. NAFROK may assign rights to affiliated entities.
